Effective July 1, 2023, all employers with at least 25 employees must use an E-Verify System to confirm the identity of new hires and their authorization to work in the US within 3 days of hiring them.

  • Employers with less than 25 employees do not need to.
  • It appears any employees that may not have the right papers are grandfathered in prior to July 1, 2023.
  • Beginning 7/1/24, if an employer fails to verify a new hire, the employer has 30 days to remedy the noncompliance.
  • If the employer has 3 violations of this new law in a 24 month period, the employer is fined $1,000 per day until the noncompliance is cured
