2025 Legislative Session Recap

FADA has worked diligently to serve the interests of new car franchised dealers in the Sunshine State for over 100 years. Although we were met with some pushback at the beginning of this Session, FADA was able to effectively assist in both passing and stopping bills that had significant impacts on our industry.

FADA was able to successfully navigate a Dealer Bill through the legislature to help further safeguard dealer rights. This legislation will help to give dealers their monthly sales goals prior to implementation and prevent manufacturers from illegally retaliating against and terminating franchise dealers.

This bill consists of three main parts:

  1. Performance Measures: Requires manufacturers to make available a written description of the performance measurement criteria to dealers before implementation. Currently the law requires dealers to request this information.
  2. Retaliation: Prohibits manufacturer actions or policies that retaliate against dealers for exercising their legal rights under Florida franchise law.
  3. Termination: Ensures that dealer terminations must be based on a substantial breach of the dealer agreement – corrects the judicial decision in the Napleton case.
